Do I Need an Attorney?
It is entirely up to you. The laws regarding worker's compensation are becoming increasingly complex and limited in nature. In most instances obtaining the assistance of an attorney who is already familiar with procedures and requirements of the Worker's Compensation Statute is very helpful. An attorney certainly can ensure peace of mind in a claimant that the proper documents are filed with the Department of Workers Claims, that requisite deadlines and rules for the submission of evidence are complied with, and that their claim is properly presented for consideration by an administrative law judge.
How Much Will it Cost For an Attorney?
This is a very frequent question. Attorney fees for claimants are set by statute at 20% of the first $25,000, 15% of the next $10,000, and 5% of the balance up to a maximum of $12,000.00. In certain cases, the attorney fee may be added to the award.
